To measure the strengths of each law, we used data on state gun policies provided by the Giffords Law Center and fatal injury statistics from the Centers for Disease Control\u2019s web-based Injury Statistics Query and Reporting System.<\/p>\n<p>For each gun policy, we ran two separate tests. Decreases in fatal injuries were most strongly correlated with gun-access and gun-use restrictions, such as owner licensing requirements, gun dealer regulations, and local regulations that allow municipalities to pass their own firearms ordinances as an addition to state gun laws.<\/p>\n<p>We also ran linear regression models to predict fatal injury rates from the strength of each state&#x27;s gun policies, after controlling for differences across states and years. Again, many gun control laws\u2014such as buyer background check and safe storage laws\u2014significantly predicted lower suicide and homicide rates. Mental health reporting laws, on the other hand, did not. This again identified a set of policies, which did not include mental health reporting laws, that each independently predicted lower rates of fatal injuries from homicides.<\/p>\n<p>These findings underscore the need for the national debate on gun laws to be guided by real data, rather than convenient political maxims or easy compromises. Our findings align with existing literature in support of one clear conclusion: A set of fundamental gun control policies has consistently been strongly associated with lower rates of fatal injury, whether from suicides or homicides.<\/p>\n<p>In the wake of the El Paso and Dayton shootings, several lawmakers joined Trump in pushing for a particular type of mental health-related gun law: \u201cred flag\u201d laws that would allow either individuals or law enforcement to petition courts to temporarily confiscate firearms from those who pose a threat to themselves or others. <a class=\"external-link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/time.com\/5646103\/red-flag-gun-law-senate-proposal\/&quot;}\" href=\"https:\/\/time.com\/5646103\/red-flag-gun-law-senate-proposal\/\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">Senators Lindsey Graham, Chuck Grassley, and John Thune have joined the chorus,<\/a> seemingly eager to chart a politically safe course on an otherwise hot-button issue. But conspicuously missing from the conversation is proof that red flag laws will actually reduce gun violence. But given the disappointing data on mental health reporting laws, it\u2019s wrong for legislators to champion red flag laws as though they are a panacea to the growing crisis of gun violence in America.<\/p>\n<p>The August 31 massacre of seven people in Odessa, Texas, is <a class=\"external-link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/www.nytimes.com\/2019\/09\/01\/us\/politics\/texas-shooting-gun-control.html&quot;}\" href=\"https:\/\/www.nytimes.com\/2019\/09\/01\/us\/politics\/texas-shooting-gun-control.html\" rel=\"nofollow noopener noreferrer\" target=\"_blank\">being cited<\/a> to push for red flag laws, but if anything, that tragedy reveals their inherent limitations in preventing gun violence. Even if Texas had a red flag law\u2014which it doesn&#x27;t\u2014we have little reason to believe the police or the shooter\u2019s family would have petitioned to take his weapons away. But at worst, they are a distraction from gun control policies that we already know to be effective. It\u2019s too early to say whether red flag laws work, but one thing is certain and empirically verifiable: stronger fundamental gun policies, fewer deaths.
