{"id":19028,"date":"2022-05-12T08:30:11","date_gmt":"2022-05-12T16:30:11","guid":{"rendered":"http:\/\/www.palada.net\/index.php\/2022\/05\/12\/news-12761\/"},"modified":"2022-05-12T08:30:11","modified_gmt":"2022-05-12T16:30:11","slug":"news-12761","status":"publish","type":"post","link":"http:\/\/www.palada.net\/index.php\/2022\/05\/12\/news-12761\/","title":{"rendered":"Europe puts Apple\u2019s CSAM plans back in the spotlight"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/images.idgesg.net\/images\/idge\/imported\/imageapi\/2021\/09\/03\/14\/apple-csam-messages-100901413-large.3x2.jpg?auto=webp&amp;quality=85,70\"\/><\/p>\n<p><strong>Credit to Author: Jonny Evans| Date: Thu, 12 May 2022 08:38:00 -0700<\/strong><\/p>\n<p>Apple may have put <a href=\"https:\/\/www.computerworld.com\/article\/3628454\/apples-plan-to-scan-us-iphones-raises-privacy-red-flags.html\">some\u00a0of its plans to scan devices for CSAM material<\/a>\u00a0on hold, but the European Commission has put them right back in the spotlight with a move to force messaging services to begin monitoring for such material.<\/p>\n<p>In terms of child protection, it\u2019s a good thing. Child Sexual Abuse Material (CSAM) is a <a href=\"https:\/\/inhope.org\/EN\/articles\/20-years-of-inhope?locale=en\" rel=\"noopener nofollow\" target=\"_blank\">far bigger problem<\/a> than many people realize; victims of this appalling trade end up with shattered lives.<\/p>\n<p>What\u2019s happening,\u00a0<em><a href=\"https:\/\/www.euractiv.com\/section\/data-protection\/news\/leak-commission-to-force-scanning-of-communications-to-combat-child-pornography\/\" rel=\"noopener nofollow\" target=\"_blank\">according to Euractiv<\/a><\/em>, is that the European Commission is planning to introduce measures requiring messaging services to perform scans for CSAM material.\u00a0However, Europe does seem to understand some of the arguments raised against Apple\u2019s original proposals by privacy advocates, and is insisting on some restrictions, specifically:<\/p>\n<p>Of course, ensuring the system is &#8220;reliable&#8221; is a challenge.<\/p>\n<p>When Apple announced its own take on CSAM scanning on its platforms, Imperial College London researchers soon <a href=\"https:\/\/www.applemust.com\/security-researchers-say-apples-csam-tech-is-easy-to-fool\/\" rel=\"noopener nofollow\" target=\"_blank\">warned\u00a0the technology behind the system was easy to fool<\/a>, calling it \u201cnot ready for deployment.&#8221;<\/p>\n<p>Apple subsequently <a href=\"https:\/\/www.computerworld.com\/article\/3644970\/did-apple-send-its-controversial-csam-scanning-back-to-the-lab.html\">stepped back its plans<\/a>, and later <a href=\"https:\/\/www.apple.com\/child-safety\/\" rel=\"noopener nofollow\" target=\"_blank\">introduced a system to monitor for such content in its Messages app<\/a>. It has not yet extended this to on-device analysis of people\u2019s Photos libraries, as it had originally intended. It remains quite possible it scans photos stored in iCloud, as other image archiving firms do.<\/p>\n<p>When it comes to Europe\u2019s proposals, there&#8217;s hope that the injunction to create \u201csuitably reliable\u201d systems will eventually face some burden of proof. While these restrictions won\u2019t completely set people\u2019s minds at rest, as the <a href=\"https:\/\/www.eff.org\/deeplinks\/2021\/08\/if-you-build-it-they-will-come-apple-has-opened-backdoor-increased-surveillance\" rel=\"noopener nofollow\" target=\"_blank\">threat<\/a> of such technologies being <a href=\"https:\/\/cdt.org\/wp-content\/uploads\/2021\/08\/CDT-Coalition-ltr-to-Apple-19-August-2021.pdf\" rel=\"noopener nofollow\" target=\"_blank\">abused by repressive or authoritarian governments remains<\/a>, it does at least set in motion steps that could coalesce around an understanding of what people\u2019s online privacy rights online should be.<\/p>\n<p>At the same time, the EC proposals seem to threaten use of end-to-end encryption, which Apple continues to argue to protect.<\/p>\n<p>The lack of a clear and agreed-upon set of rights to protect online privacy is becoming increasingly critical as the world becomes more connected. At the same time, Europe is also insisting on regulations \u2014 such as <a href=\"https:\/\/www.computerworld.com\/article\/3655731\/apple-can-support-sideloading-while-protecting-the-rest-of-us.html\">mandatory sideloading<\/a>\u00a0\u2014 that may erode privacy and security on devices. These two strands seem philosophically opposed, but it is possible that as regulators and lawmakers consider the complexity of these issues, they will begin to see some glimmer of light.<\/p>\n<p>I think this is what Apple is working to encourage, as it seems increasingly vital (even the <a href=\"https:\/\/www.weforum.org\/agenda\/2020\/08\/here-s-why-we-need-a-declaration-of-global-digital-human-rights\/\" rel=\"noopener nofollow\" target=\"_blank\">World Economic Forum\u00a0agrees<\/a>) that an international standard to define digital rights is developed. And the need for that standard is growing.<\/p>\n<p>Europe understands this; it <a href=\"https:\/\/ec.europa.eu\/commission\/presscorner\/detail\/en\/IP_22_452\" rel=\"noopener nofollow\" target=\"_blank\">put forward a declaration on digital rights and principles for EU residents<\/a> in early 2022.<\/p>\n<p>When it did, Executive Vice-President for a Europe Fit for the Digital Age Margrethe Vestager said in a statement: \u201cWe want safe technologies that work for people, and that respect our rights and values. Also when we are online. And we want everyone to be empowered to take an active part in our increasingly digitized societies. This declaration gives us a clear reference point to the rights and principles for the online world.\u201d<\/p>\n<p>Apple executives have been actively <a href=\"https:\/\/www.applemust.com\/apple-sends-cpo-to-eu-privacy-conference-ceo-attended-twice\/\" rel=\"noopener nofollow\" target=\"_blank\">lobbying\u00a0for frameworks around such rights<\/a>\u00a0for some time. Ever since Apple CEO Tim Cook\u2019s <a href=\"https:\/\/www.applemust.com\/this-is-surveillance-warns-apples-tim-cook-in-blistering-eu-privacy-speech\/\" rel=\"noopener nofollow\" target=\"_blank\">powerful speech\u00a0on digital surveillance<\/a>\u00a0in 2018, the company has constantly and (mostly) consistently lobbied for agreement around personal privacy. Cook\u2019s company continues to work toward <a href=\"https:\/\/www.computerworld.com\/article\/3614148\/apple-switches-off-the-open-web-by-making-it-better.html\">providing such rights on a unilateral basis<\/a>, but also calls for universality in such protection.
