Back in 2021, the&nbsp;social media dance extravaganza platform <a href=\"https:\/\/www.malwarebytes.com\/blog\/news\/2021\/02\/tiktok-pays-92-million-to-end-data-theft-lawsuit\">agreed to pay $92m<\/a> to settle dozens of lawsuits alleging harvesting of personal data. There has also been concern with regard to whether or not settings were <a href=\"https:\/\/www.malwarebytes.com\/blog\/news\/2021\/01\/are-tiktoks-new-settings-enough-to-keep-kids-safe\">enough to keep children safe<\/a>, leading to significant alterations to how those accounts are managed.<\/p>\n<p dir=\"ltr\">Unfortunately for TikTok, it&#8217;s back in the news again, and not in a good way. TikTok could be <a href=\"https:\/\/www.reuters.com\/world\/uk\/uk-could-fine-tiktok-29-mln-failing-protect-childrens-privacy-2022-09-26\">headed for a $28.91m fine<\/a>, courtesy of the United Kingdom. The fine, related to how children are safeguarded on the app, is the result of a possible breach of the UK&rsquo;s data protection laws.<\/p>\n<h2 dir=\"ltr\">The provisional findings of the ICO<\/h2>\n<p dir=\"ltr\">The Information Commissioner&rsquo;s Office (ICO) has <a href=\"https:\/\/ico.org.uk\/about-the-ico\/media-centre\/news-and-blogs\/2022\/09\/ico-could-impose-multi-million-pound-fine-on-tiktok-for-failing-to-protect-children-s-privacy\/\">issued a statement<\/a>, which refers to TikTok potentially breaching UK data protection law between May 2018 and July 2020. The statement explains that the ICO has issued TikTok with a notice of intent, which&nbsp;is a legal document which may precede a legal fine.<\/p>\n<p dir=\"ltr\">The ICO claims TikTok may have:<\/p>\n<ul>\n<li dir=\"ltr\" style=\"list-style-type: disc;\" aria-level=\"1\">\n<p dir=\"ltr\" role=\"presentation\">Processed the data of children under the age of 13 without appropriate parental consent;<\/p>\n<\/li>\n<li dir=\"ltr\" style=\"list-style-type: disc;\" aria-level=\"1\">\n<p dir=\"ltr\" role=\"presentation\">Failed to provide proper information to its users in a concise, transparent and easily understood way; and<\/p>\n<\/li>\n<li dir=\"ltr\" style=\"list-style-type: disc;\" aria-level=\"1\">\n<p dir=\"ltr\" role=\"presentation\">Processed special category data, without legal grounds to do so.<\/p>\n<\/li>\n<\/ul>\n<p>The statement notes that these findings are &ldquo;provisional&rdquo;, and that no conclusions should be drawn at this stage&nbsp;around whether &ldquo;there has, in fact, been any breach of data protection law or that a financial penalty will ultimately be imposed. We will carefully consider any representations from TikTok before taking a final decision&rdquo;.<\/p>\n<p>In other words: all of these claims and statements come with a rather large &ldquo;allegedly&rdquo; tag applied, and TikTok will make a response to these concerns before anything else happens of a legal nature.<\/p>\n<p>TikTok <a href=\"https:\/\/www.gizmodo.com.au\/2022\/09\/tiktok-may-have-illegally-used-kids-data-for-2-years-uk-privacy-regulator-says\/\">isn&rsquo;t currently commenting<\/a>, citing &ldquo;confidentiality&rdquo; which makes sense given the intent to formally respond to the ICOs findings.<\/p>\n<h2>Tackling the child data problem<\/h2>\n<p>This appears to be part of a <a href=\"https:\/\/www.theguardian.com\/technology\/2022\/sep\/26\/tiktok-fine-protect-children-privacy-uk-data-protection\">much bigger drive<\/a> to ensure children&rsquo;s data is used safely and correctly by online services. According to the Guardian, The ICO Information Commissioner stated that the ICO is looking at &ldquo;more than 50&rdquo; online services to check for child-centric data compliance.<\/p>\n<p>There&rsquo;s a big push for child safety at the moment, especially&nbsp;with regard to making sure businesses are complying with regulations. Some of these drives are perhaps a <a href=\"https:\/\/www.malwarebytes.com\/blog\/news\/2022\/09\/controversial-kids-code-aims-to-keep-children-safe-online\">little bit controversial<\/a>, too.
