{"id":18004,"date":"2022-02-02T10:22:21","date_gmt":"2022-02-02T18:22:21","guid":{"rendered":"https:\/\/www.palada.net\/index.php\/2022\/02\/02\/news-11737\/"},"modified":"2022-02-02T10:22:21","modified_gmt":"2022-02-02T18:22:21","slug":"news-11737","status":"publish","type":"post","link":"https:\/\/www.palada.net\/index.php\/2022\/02\/02\/news-11737\/","title":{"rendered":"Senate Committee passes new antitrust bill aimed at Big Tech companies"},"content":{"rendered":"<p><strong>Credit to Author: Malwarebytes Labs| Date: Wed, 26 Jan 2022 17:14:15 +0000<\/strong><\/p>\n<p>The&nbsp;<u><a href=\"#idb9b8d6beb93e469a89248c3d719f8f73\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">American Innovation and Choice <\/a><a href=\"https:\/\/www.congress.gov\/bill\/117th-congress\/senate-bill\/2992\/text\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Online<\/a><a href=\"#idb9b8d6beb93e469a89248c3d719f8f73\" target=\"_blank\" rel=\"noreferrer noopener nofollow\"> Act (AICOA)<\/a><\/u>, a bill that forbids Big Tech platforms like Apple, Alphabet (Google\u2019s parent company), and Amazon from generally behaving in an anti-competitive manner, was approved by the Senate Judiciary Committee late last week with a 16-6 vote.<\/p>\n<p>US Senator Amy Klobuchar of Minnesota, a primary sponsor of the bill, called this &#8220;the first time that a major tech bill on competition has advanced to the Senate floor since the dawn of the internet.&#8221;<\/p>\n<h2>What is antitrust law?<\/h2>\n<p>Antitrust law is a set of statutes aimed at protecting consumers by ensuring that no single company or group of companies gain so much power that they can tip market prices in their favor, or warp the competitive market. In the United States, the Federal Trade Commission (FTC)\u2014in tandem with the Bureau of Economics\u2014is the governing agency that\u00a0<u><a href=\"https:\/\/www.ftc.gov\/tips-advice\/competition-guidance\/guide-antitrust-laws\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">enforces antitrust laws<\/a><\/u>.<\/p>\n<p>Antitrust laws protect against tactics that don\u2019t promote innovation and competition. Countries all over the world have their own version of these laws, such as the\u00a0<u><a href=\"https:\/\/en.wikipedia.org\/wiki\/Competition_and_Consumer_Act_2010\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Competition and Consumer Act 2010 (CCA)<\/a><\/u>\u00a0(Australia), the\u00a0<u><a href=\"https:\/\/www.oecd.org\/daf\/competition\/prosecutionandlawenforcement\/1817679.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Brazilian Antitrust Law<\/a><\/u>\u00a0[PDF] (Brazil), the\u00a0<u><a href=\"https:\/\/www.cecc.gov\/resources\/legal-provisions\/prc-anti-monopoly-law-chinese-and-english-text\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Anti-Monopoly Law of the People\u2019s Republic of China<\/a><\/u>\u00a0(China),\u00a0and <u><a href=\"https:\/\/www.jftc.go.jp\/en\/legislation_gls\/amended_ama09\/index.html\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">the Antimonopoly Act<\/a><\/u>\u00a0(Japan).<\/p>\n<p>Countries with antitrust laws enforce it their own way. The US Department of Justice (DOJ), for example, can file a civil or criminal charge against the companies or the executives heading them.<\/p>\n<h2>About AICOA and its possible effects<\/h2>\n<p>The American Innovation and Choice Act is a bill aimed at breaking up Big Tech firms and curbing their allegedly monopolistic behavior. It was\u00a0<u><a href=\"https:\/\/cicilline.house.gov\/press-release\/house-lawmakers-release-anti-monopoly-agenda-stronger-online-economy-opportunity\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">first introduced<\/a><\/u>\u00a0by Rep. David Cicilline of Rhode Island and Rep. Ken Buck of Colorado in June 2021 along with\u00a0<u><a href=\"https:\/\/arstechnica.com\/tech-policy\/2021\/06\/five-new-bills-aim-to-break-up-big-tech-platforms-force-them-to-play-nice\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">four other bills<\/a><\/u>, namely: the <u><a href=\"https:\/\/cicilline.house.gov\/sites\/cicilline.house.gov\/files\/documents\/Platform Competition and Opportunity Act - Bill Text (1).pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Platform Competition and Opportunity Act<\/a><\/u>, the <u><a href=\"https:\/\/cicilline.house.gov\/sites\/cicilline.house.gov\/files\/documents\/Ending Platform Monopolies - Bill Text.pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Ending Platform Monopolies Act<\/a><\/u>, the <u><a href=\"https:\/\/cicilline.house.gov\/sites\/cicilline.house.gov\/files\/documents\/ACCESS Act - Bill Text (1).pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Augmenting Compatibility and Competition by Enabling Service Switching (ACCESS) Act<\/a><\/u>, (which <a href=\"https:\/\/blog.malwarebytes.com\/privacy-2\/2019\/11\/access-act-might-improve-data-privacy-through-interoperability\/\">we wrote about<\/a> previously) and the <u><a href=\"https:\/\/cicilline.house.gov\/sites\/cicilline.house.gov\/files\/documents\/Merger Filing Fee Modernization Act of 2021 - Bill Text (1).pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">Merger Filing Fee Modernization Act<\/a><\/u>.<\/p>\n<p>&#8220;Right now, unregulated tech monopolies have too much power over our economy,&#8221; Cicilline said in\u00a0<u><a href=\"https:\/\/cicilline.house.gov\/press-release\/house-lawmakers-release-anti-monopoly-agenda-stronger-online-economy-opportunity\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">a press release<\/a><\/u>\u00a0last year. &#8220;They are in a unique position to pick winners and losers, destroy small businesses, raise prices on consumers, and put folks out of work. Our agenda will level the playing field and ensure the wealthiest, most powerful tech monopolies play by the same rules as the rest of us.&#8221;<\/p>\n<p>Unfortunately, AICOA&nbsp;<u><a href=\"https:\/\/www.cnbc.com\/2021\/06\/24\/house-committee-passes-broad-tech-antitrust-reforms.html\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">was voted out<\/a><\/u>&nbsp;of the House Judiciary Committee.<\/p>\n<p>In October 2021, three months later, Senators Klobuchar and Chuck Grassley\u2014of Iowa\u2014introduced a similar bill that shares the same name and broad features of Cicilline\u2019s bill. This, eventually, resurrected AICOA from the grave.<\/p>\n<p>This bill prohibits companies\u2014which fit in a criteria that would be set out by the FTC pertaining (but perhaps not limited) to active userbase and market cap\u2014from discriminating against other businesses that rely on their platform by favoring their own products and services.<\/p>\n<p>If the Senate passes the bill, it would make it illegal for companies with their own marketplace, such as Amazon, Apple, and Google, from favouring their own products and services over other competitors. Amazon, for example, would be barred from ranking its AmazonBasics brand higher than other brands in search results on the Amazon market.<\/p>\n<p>But AICOA&#8217;s implications could go beyond this, as many have pointed out on Twitter:<\/p>\n<figure class=\"wp-block-embed is-type-rich is-provider-twitter wp-block-embed-twitter\">\n<div class=\"wp-block-embed__wrapper\">\n<blockquote class=\"twitter-tweet\" data-width=\"550\" data-dnt=\"true\">\n<p lang=\"en\" dir=\"ltr\">This <a href=\"https:\/\/twitter.com\/hashtag\/antitrust?src=hash&amp;ref_src=twsrc%5Etfw\">#antitrust<\/a> bill requires companies to take down protections in place to stop hackers from accessing devices and stealing personal information.
