{"id":23382,"date":"2023-11-14T11:32:27","date_gmt":"2023-11-14T19:32:27","guid":{"rendered":"http:\/\/www.palada.net\/index.php\/2023\/11\/14\/news-17112\/"},"modified":"2023-11-14T11:32:27","modified_gmt":"2023-11-14T19:32:27","slug":"news-17112","status":"publish","type":"post","link":"https:\/\/www.palada.net\/index.php\/2023\/11\/14\/news-17112\/","title":{"rendered":"Asian Americans Raise Alarm Over \u2018Chilling Effects\u2019 of Section 702 Surveillance Program"},"content":{"rendered":"<p><img decoding=\"async\" src=\"https:\/\/media.wired.com\/photos\/6552f37819a7ed4496ccd1dc\/master\/pass\/Section-702-AAPI-Security-1328559764.jpg\"\/><\/p>\n<p><strong>Credit to Author: Dell Cameron| Date: Tue, 14 Nov 2023 16:53:14 +0000<\/strong><\/p>\n<p class=\"BylineWrapper-jWHrLH hAfVoD byline bylines__byline\" data-testid=\"BylineWrapper\" itemprop=\"author\" itemtype=\"http:\/\/schema.org\/Person\"><span itemprop=\"name\" class=\"BylineNamesWrapper-jbHncj fuDQVo\"><span data-testid=\"BylineName\" class=\"BylineName-kwmrLn cVPPwi byline__name\"><a class=\"BaseWrap-sc-gjQpdd BaseText-ewhhUZ BaseLink-eNWuiM BylineLink-gEnFiw iUEiRd kZoQA-D ecbzIP BDKtv byline__name-link button\" href=\"\/author\/dell-cameron\">Dell Cameron<\/a><\/span><\/span><\/p>\n<p>Dozens of prominent Asian American groups are asking United States lawmakers this morning to hold fast in the face of an anticipated campaign by congressional leaders to extend the Section 702 surveillance program by securing it, like a rider, to another \u201cmust pass\u201d bill.<\/p>\n<p class=\"paywall\">Sixty-three groups across the country representing and allied with Asian American and Pacific Islander communities have <a data-offer-url=\"https:\/\/stopaapihate.org\/2023\/11\/14\/reject-short-term-reauthorization-section-702\/\" class=\"external-link\" data-event-click=\"{&quot;element&quot;:&quot;ExternalLink&quot;,&quot;outgoingURL&quot;:&quot;https:\/\/stopaapihate.org\/2023\/11\/14\/reject-short-term-reauthorization-section-702\/&quot;}\" href=\"https:\/\/stopaapihate.org\/2023\/11\/14\/reject-short-term-reauthorization-section-702\/\" rel=\"nofollow noopener\" target=\"_blank\">signed a letter<\/a> of \u201cstrong opposition\u201d to any \u201cshort-term extension\u201d of the 702 program\u2014surveillance, the groups say, that is almost certainly impacting Asian Americans at a disproportionate rate.<\/p>\n<p class=\"paywall\">WIRED first reported last week on an <a href=\"https:\/\/www.wired.com\/story\/section-702-nsa-surveillance-senate\/\">effort underway by US Senate leaders<\/a> to extend the 702 program, which is slated to expire at the end of the year but may continue until April under the program\u2019s \u201ctransition procedures.\u201d Emails from WIRED requesting comment from the Senate majority leader, Chuck Schumer, have gone unanswered since Friday.<\/p>\n<p class=\"paywall\">\u201cSection 702 and related surveillance authorities have been misused to spy on Americans, including but not limited to protesters, journalists, campaign donors, and members of Congress,\u201d says the letter, signed by the National Council of Asian Pacific Americans, the Sikh Coalition, Asian Americans Advancing Justice, and the Stop AAPI Hate coalition, among dozens of other groups. The consequences of unlawful surveillance have had a \u201cdevastating toll\u201d on Asian Americans, they say, and on people\u2019s \u201ccareers, livelihoods, and reputations.\u201d<\/p>\n<p class=\"paywall\">Demanding the 702 program be \u201cpursued through standalone legislation\u201d and open to debate, the letter says a short-term fix would alienate lawmakers already open to salvaging the program\u2014albeit <a href=\"https:\/\/www.wired.com\/story\/government-surveillance-reform-act-2023\/\">with heavily favored reforms<\/a>. Renewing the program with a last-minute amendment tucked into a bill the government can\u2019t function without would only serve to undermine the democratic process, the groups say, and \u201cimperil the long-term viability of Section 702.\u201d<\/p>\n<p class=\"paywall\">\u201cThere are a lot of folks who are really worried,\u201d says Andy Wong, managing director of advocacy at Stop AAPI Hate, a coalition of community-based groups. The impact of government surveillance on the broader Asian American community, he says, runs deep. &quot;Whether it\u2019s traveling or communicating with their loved ones or doing anything abroad, even if it\u2019s completely innocuous, all of this surveillance has a chilling effect.\u201d<\/p>\n<p class=\"paywall\">\u201cApproximately two-thirds of Asian Americans are immigrants,\u201d says Joanna YangQing Derman, a program director at Asian Americans Advancing Justice, the civic engagement and civil rights nonprofit. \u201cWe are far more likely to have family, friends, and business associates abroad. The program, which works to gather intel for counterterrorism, espionage, and cyber defense investigations, relies on the compulsory assistance of US telecom providers\u2014a power granted on a year-by-year basis through \u201ccertifications\u201d by a secret court.<\/p>\n<p class=\"paywall\">Despite the government\u2019s avowed efforts not to intercept and store Americans\u2019 internet communications in bulk, the NSA is known to capture significant volumes of domestic calls, texts, and emails between Americans and people overseas. The law, as it is, does little to prevent federal agents from dredging up the content of those calls or messages later without a warrant, for reasons often irrelevant to why they were captured in the first place.<\/p>\n<p class=\"paywall\">On Monday, another letter directed at Senator majority leader Chuck Schumer was signed by <a href=\"https:\/\/www.wired.com\/story\/section-702-surveillance-reauthorization-privacy-letter\/\">more than 20 civil liberties groups<\/a> that are likewise opposed to any attempt to prolong 702 surveillance, which falls under the Foreign Intelligence Surveillance Act (FISA), by linking its fate to a spending bill that will be inevitably negotiated at a high level, with little or no opportunity for amendment once it reaches the House or Senate floor.
