{"id":25550,"date":"2024-12-10T05:10:09","date_gmt":"2024-12-10T13:10:09","guid":{"rendered":"http:\/\/www.palada.net\/index.php\/2024\/12\/10\/news-19279\/"},"modified":"2024-12-10T05:10:09","modified_gmt":"2024-12-10T13:10:09","slug":"news-19279","status":"publish","type":"post","link":"https:\/\/www.palada.net\/index.php\/2024\/12\/10\/news-19279\/","title":{"rendered":"TikTok ban in US: Company seeks emergency injunction to prevent it"},"content":{"rendered":"\n<p>TikTok has <a href=\"https:\/\/sf16-va.tiktokcdn.com\/obj\/eden-va2\/hkluhazhjeh7jr\/2024.12.09%20-%20TTI%20v.%20Garland%20-%20Petitioners'%20Emergency%20Motion%20for%20Injunction(1).pdf\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">requested an emergency injunction<\/a> to stop or postpone the planned ban on the platform in the US.<\/p>\n<p>Back <a href=\"https:\/\/www.malwarebytes.com\/blog\/news\/2024\/03\/tiktok-faces-ban-in-us-unless-it-parts-ways-with-chinese-owner-bytedance\">in March<\/a>, the House of Representatives\u00a0<a href=\"https:\/\/www.congress.gov\/bill\/118th-congress\/house-bill\/7521\/text?s=2&amp;r=2\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">passed a bill<\/a>\u00a0that would effectively ban TikTok from the US unless Chinese owner ByteDance agreed to give up its share of the immensely popular app.<\/p>\n<p>TikTok <a href=\"https:\/\/x.com\/TikTokPolicy\/status\/1865080490161492208\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">claims<\/a> this is censorship and collides with the principle of free speech. However, the company&#8217;s post on X got a lot of responses from people who feel TikTok itself banned them for no clear reason.<\/p>\n<p>On Friday, December 6, a federal appeals court panel unanimously upheld the law that gave ByteDance, TikTok&#8217;s Chinese parent company, nine months to either get a new owner or be banned in the US. The deadline is looming; unless the courts stop it, it will go into effect January 19, 2025.<\/p>\n<p>Free speech advocates agree with TikTok that a ban would violate First Amendment rights to free speech, mainly because it would set a precedent. The American Civil Liberties Union <a href=\"https:\/\/www.reuters.com\/legal\/us-appeals-court-upholds-tiktok-law-forcing-its-sale-2024-12-06\/\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">said to Reuters<\/a>:<\/p>\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p>&#8220;Banning TikTok blatantly violates the First Amendment rights of millions of Americans who use this app to express themselves and communicate with people around the world.&#8221;<\/p>\n<\/blockquote>\n<p>Ever since a former executive at TikTok\u2019s parent company ByteDance claimed in court documents that the&nbsp;<a href=\"https:\/\/www.malwarebytes.com\/blog\/news\/2023\/06\/former-tiktok-executive-says-chinese-communist-party-members-had-god-mode-entry-to-tiktok-data\">Chinese Communist Party (CCP) had access to TikTok data<\/a>, despite the data being stored in the US, TikTok has been battling to convince politicians that it operates independently of ByteDance, which has deep ties to the CCP.<\/p>\n<p>As early as in 2022, the FCC called TikTok an unacceptable security risk which should be removed from app stores, <a href=\"https:\/\/www.documentcloud.org\/documents\/24766779-bytedance-musical-commission-statement\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">saying<\/a>\u00a0it had referred a complaint against TikTok and parent company ByteDance to the Department of Justice for collecting personal information from children without parental consent.<\/p>\n<p>Since 2020, several governments and organizations have banned, or considered banning, TikTok from their staff\u2019s devices. And during a US Senate hearing, General Paul Nakasone, Director of the National Security Agency (NSA) stated that \u201c<a href=\"https:\/\/www.malwarebytes.com\/blog\/news\/2023\/03\/tiktok-closer-to-getting-banned-because-it-could-use-data-to-influence-opinions\">America\u2019s TikTok-addicted youth is playing with a loaded gun<\/a>.\u201d<\/p>\n<p>Meanwhile TikTok also received orders to <a href=\"https:\/\/www.malwarebytes.com\/blog\/news\/2024\/11\/tiktok-ordered-to-close-canada-offices-following-national-security-review\">close its offices in Canada<\/a> following a national security review. The app has already completely been banned in India, Kyrgyzstan, Uzbekistan, Nepal, and Somalia.<\/p>\n<p><a href=\"https:\/\/newsroom.tiktok.com\/en-us\/tiktok-files-emergency-motion-for-injunction\" target=\"_blank\" rel=\"noreferrer noopener nofollow\">According to TikTok<\/a>, a ban on the platform would cause small businesses to lose over $1 billion in revenue within just one month, while creators would suffer $300 million in lost earnings.<\/p>\n<p>TikTok&#8217;s petition has requested that the Court of Appeals make a decision on the injunction by December 16, 2024.<\/p>\n<p>We will keep you posted.<\/p>\n<p><strong>We don&#8217;t just report on threats &#8211; we help protect your social media<\/strong><\/p>\n<p>Cybersecurity risks should never spread beyond a headline.
