Persaud<\/strong>, a California man profiled in a <a href=\"http:\/\/krebsonsecurity.com\/2014\/11\/still-spamming-after-all-these-years\/\" target=\"_blank\">Nov. 2014 KrebsOnSecurity story<\/a> about a junk email purveyor tagged as one of the World&#8217;s Top 10 Worst Spammers, was indicted this week on federal wire fraud charges tied to an alleged spamming operation.<\/p>\n<p>According to an indictment returned in federal court in Chicago, Persaud used multiple Internet addresses and domains \u2013 a technique known as \u201csnowshoe spamming\u201d \u2013 to transmit spam emails over at least nine networks.<\/p>\n<p><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-28602\" src=\"https:\/\/krebsonsecurity.com\/wp-content\/uploads\/2014\/11\/persaud-fb.png\" alt=\"persaud-fb\" width=\"410\" height=\"174\" \/><\/p>\n<p>The <strong>Justice Department<\/strong> says\u00a0<span class=\"il\">Persaud<\/span> sent well over a million spam emails to recipients in the United States and abroad. Prosecutors charge that Persaud often used false names to register the domains, and he created fraudulent \u201cFrom:\u201d address fields to conceal that he was the true sender of the emails. The government also accuses\u00a0<span class=\"il\">Persaud<\/span> of &#8220;illegally transferring and selling millions of email addresses for the purpose of transmitting spam.&#8221;<\/p>\n<p>Persaud is currently <a href=\"https:\/\/www.spamhaus.org\/rokso\/spammer\/SPM1319\/michael-persaud\" target=\"_blank\">listed as #8<\/a> on the <a href=\"https:\/\/www.spamhaus.org\/statistics\/spammers\/\" target=\"_blank\">World\u2019s 10 Worst Spammers list<\/a> maintained by <a href=\"https:\/\/krebsonsecurity.com\/?s=spamhaus&amp;x=0&amp;y=0\" target=\"_blank\">Spamhaus<\/a>, an anti-spam organization. In 1998, Persaud was <a href=\"http:\/\/articles.latimes.com\/1998\/dec\/29\/business\/fi-58482\" target=\"_blank\">sued by AOL<\/a>, which charged that he committed fraud by using various names to send millions of get-rich-quick spam messages to America Online customers. Persaud did not contest the charges and was <a href=\"https:\/\/web.archive.org\/web\/20080705210156\/http:\/\/legal.web.aol.com\/decisions\/dljunk\/persaudorder.html\" target=\"_blank\">ordered<\/a> to pay more than a half-million dollars in restitution and damages.<span id=\"more-37997\"><\/span><\/p>\n<p>In 2001, the San Diego District Attorney\u2019s office <a href=\"http:\/\/news.cnet.com\/California-throws-the-book-at-spam\/2100-1023_3-254262.html\" target=\"_blank\">filed criminal charges against Persaud<\/a>, alleging that he and an accomplice crashed a company\u2019s email server after routing their spam through the company\u2019s servers.<\/p>\n<p>Persaud has not responded to requests for comment. But he maintains that his email marketing business is legitimate and complies with the <a href=\"https:\/\/en.wikipedia.org\/wiki\/CAN-SPAM_Act_of_2003\" target=\"_blank\">CAN-SPAM Act<\/a>, the main anti-spam law in the United States. The law prohibits the sending of spam that spoofs that sender\u2019s address or does not give recipients an easy way to opt out of receiving future such emails from that sender.<\/p>\n<p>Persaud told FBI agents who <a href=\"https:\/\/krebsonsecurity.com\/2016\/06\/fbi-raids-spammer-outed-by-krebsonsecurity\/\" target=\"_blank\">raided\u00a0his home last year<\/a> that he currently conducts internet marketing from his residence by sending a million emails in under 15 minutes from various domains and Internet addresses.<\/p>\n<p>The indictment charges Persaud with ten counts of wire fraud and seeks the forfeiture of four computers. Each count of wire fraud is punishable by up to 20 years in prison.
